Terms of Service

Effective Date: May 3, 2026

Welcome to Transi Core Container (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, services, and related communications.

By accessing our website, requesting a quote, placing an order, or purchasing a product, you agree to be bound by these Terms. If you do not agree, you must discontinue use of our website and services immediately.

1. Eligibility and Use of Website

By using this website, you confirm that you are at least 18 years old and legally capable of entering into binding agreements under applicable U.S. law. You agree to use this website only for lawful purposes.

You strictly agree that you may not:

  • Violate applicable federal, state, or local laws and regulations.
  • Interfere with website security, infrastructure, or global functionality.
  • Misrepresent your identity, affiliation, or provide false commercial information.
  • Attempt unauthorized access to our local hosting systems, networks, or data grids.
  • Engage in fraudulent transaction activity or deceptive practices.

We reserve the right to suspend, restrict, or terminate website access at our sole discretion without prior notice.

2. Products and Services

We market and sell new, one-trip, used, refurbished, modified, and specialized shipping containers, including standard cargo boxes and custom architectural solutions.

Product descriptions, grading specifications, real-time pricing, and regional yard availability are subject to immediate change without notice. Official confirmation of any order requires a fully executed written agreement, quote sign-off, or commercial invoice. We reserve the right to modify or discontinue products, grades, or custom services at any time.

3. Quotes, Orders, and Payment

Quotes: All written quotes are non-binding estimates and fluctuate due to steel market conditions, live inventory availability, logistics constraints, or customer-specific site demands. Quotes are valid exclusively for the stated window.

Orders: An order is considered structurally confirmed only after payment has been verified, cleared, and officially acknowledged by Transi Core Container. We reserve the right to accept or decline any purchase order at our discretion.

Payment: Payment structures are communicated prior to scheduling dispatch. Failure to comply with agreed payment terms may result in immediate order cancellation, freight hold delays, or administrative storage fees.

4. Pricing and Taxes

All prices are itemized and transacted in U.S. Dollars (USD) unless explicitly stated otherwise in writing.

Full or approved partial payment must be cleared before any container is released from our yard or scheduled for transit. Prices do not include applicable state/local taxes, delivery fees, offloading, site preparation, or specialized wide-load handling unless explicitly documented. Customers hold sole responsibility for all applicable sales tax, use tax, duties, and statutory fees.

5. Shipping and Delivery

Delivery timelines are logistics estimates (typically 5–7 business days) and do not constitute a fixed guarantee. Delayed deliveries may occur due to adverse weather conditions, DOT road constraints, transit bottlenecks, supply chain disruptions, or events beyond our reasonable control.

💰 Flat-Rate Commitment: We operate on a flat-rate delivery fee of $550 per order, with no hidden fuel or drop surcharges.

Risk of structural loss and responsibility for the container transfer completely to the buyer upon successful offloading or physical yard pickup. The buyer carries sole responsibility for ensuring proper heavy truck site access, firm level ground, and immediate delivery readiness.

6. Inspection, Condition, and Acceptance

Containers are sold strictly in the condition and grade disclosed at the time of sale. Cosmetic wear such as minor dents, surface rust, or faded paint is standard for used cargo containers and does not impair structural integrity or watertight status.

48-Hour Claim Window: Buyers must thoroughly inspect units upon offloading. Any claims regarding incorrect sizes, structural damage, or undisclosed material defects must be reported in writing within 48 hours of delivery. Retaining or utilizing the container constitutes final acceptance.

7. Modifications and Custom Work

Custom-built and modified containers are engineered according to customer-approved drawings and technical specifications. Due to materials fabrication allocation, custom orders are completely non-cancelable and non-refundable once production begins in our yards.

Customers are independently responsible for ensuring that their intended container use complies with local zoning rules, building codes, and municipal regulations.

8. Returns, Refunds, and Cancellations

Returns, refunds, and order cancellations are strictly governed by our standalone Return & Refund Policy, which is fully incorporated into these Terms by reference.

  • All freight equipment sales are generally final unless explicitly authorized in writing.
  • Returns are audited within 30 calendar days of delivery under strict baseline conditions.
  • Custom-modified structures are completely non-returnable unless structural defect is verified at delivery.
  • Approved cancellations must be logged prior to container yard loading and truck dispatch.

9. Warranty Disclaimer

“AS IS” Terms: All containers are sold on an “AS IS” and “WHERE IS” basis unless explicitly covered by a written structural guarantee. To the fullest extent permitted by law, Transi Core Container disclaims all warranties, express or implied, including but not limited to merchantability, structural fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Transi Core Container shall not be held liable for indirect, incidental, consequential, special, or punitive damages—including, but not limited to, loss of commercial profits, business interruption, or site damage. Our absolute total liability shall never exceed the exact net amount paid by the customer for the specific product or service giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Transi Core Container, its officers, logistics operators, and affiliates from any legal claims, damages, liabilities, or financial expenses arising directly from your use of our equipment, violation of these site Terms, improper field installation, or violation of local zoning ordinances.

12. Intellectual Property Rights

All website architecture, textual content, product photography, vector illustrations, graphics, and branding layout are the exclusive property of Transi Core Container or its partners and are protected under U.S. copyright laws. Unauthorized reproduction, scraping, copying, or mirroring is strictly prohibited.

13. Governing Law

These Terms of Service and any associated commercial transactions shall be governed by, and interpreted in accordance with, the laws of the State of Texas, without regard to conflict-of-law principles. Any legal disputes must enter good-faith mediation prior to escalating to binding arbitration or courts within Texas.

14. Force Majeure

We are not liable for delivery failures, yard delays, or supply chain blockages caused directly by events beyond our reasonable control, including natural disasters, acts of God, labor strikes, DOT road closures, state governmental restrictions, or extreme weather blockades.
